Thinking selling a leasehold flat? Check whether you may need a Landlord Deed of Certificate

If you are thinking of putting your flat on the market and your building is:

  • over 11 metres in height

  • has more than 2 residents

  • is a leasehold building

it is worth following the attached links.

We have recently completed a Sales Pack for a resident, the prospective buyer’s solicitor requested a Leaseholder Deed of Certificate.

The building is question has no residual or future claims (the construction is brick and concrete, absolutely no cladding); however, the buyer’s solicitors insisted that this protection was put in place.

The request can add complexity and potential delay into your sales process, so it good practice to ask your solicitor to be prepared.

 Also, ask your Property Manager to include this (where the three criteria above apply) in the sales pack process. It will save time and delay.
